By accessing or using ForeverMelody ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ForeverMelody provides a platform for creating personalised songs using artificial intelligence. Our service includes:

• AI-generated lyrics based on information you provide
• AI-generated audio/music for your personalised song
• A shareable song page with audio player and lyrics
• MP3 download option (for Memorable Moment products)
• Optional digital gift card feature

3. Orders and Payment

3.1 Order Process

When you place an order:

1. You select a product type (Basic Song or Memorable Moment) and bundle size
2. You complete payment through our secure Stripe checkout
3. You fill out the intake form with recipient and song details
4. We generate your personalised song(s) using AI technology
5. You receive email notification when your song is ready

3.2 Payment

All payments are processed securely through Stripe. Prices are displayed in GBP (£). By completing payment, you authorise us to charge your payment method for the total amount shown at checkout.

4. No Refund Policy

All sales are final. We do not offer refunds for any reason once payment is completed and your order is submitted. This is because we immediately begin the creative process upon payment confirmation. Please review our Refund Policy for complete details.

5. User Responsibilities

You agree to:

• Provide accurate and complete information in the intake form
• Ensure you have the right to use any personal information you provide about recipients
• Not use the Service for any illegal or unauthorised purpose
• Not attempt to gain unauthorised access to our systems
• Not reproduce, distribute, or create derivative works from our songs for commercial purposes without permission

6. Intellectual Property

6.1 Your Rights

Upon completion and delivery of your personalised song:

• You receive a non-exclusive license to use, share, and download your song for personal, non-commercial purposes
• For Memorable Moment products, you may download the MP3 and use it as you wish for personal use
• You may share the song page link with others

6.2 Our Rights

ForeverMelody retains all rights to the Service, technology, and platform. The AI-generated content is created using our proprietary processes, and we reserve the right to use anonymised data for service improvement.

7. Content and Accuracy

While we strive for accuracy and quality, AI-generated content may occasionally contain errors or may not perfectly match your expectations. The final song is based on the information you provide, and we are not responsible for outcomes resulting from incomplete, inaccurate, or misleading information in your intake form.

8. Delivery and Processing Time

Standard processing time is typically 24-48 hours after you complete the intake form. Express delivery (if purchased) aims for completion within 60 minutes, subject to system availability and complexity.

We are not liable for delays caused by technical issues, third-party service failures, or circumstances beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, ForeverMelody shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless ForeverMelody from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
